Terms of Service
These terms govern our relationship with clients and users of our concrete construction services. Please read them carefully before engaging our services.

Acceptance of Terms
By engaging Concrete Contractors of Tyler for services, requesting quotes, or using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website.
Services Description
Concrete Contractors of Tyler provides commercial concrete construction services including but not limited to:
- Commercial foundations and structural slabs
- Post-tension concrete systems
- Industrial and warehouse floors
- Tilt-up concrete wall construction
- Parking lots, decks, and structures
- Concrete repair and restoration
- Sitework and earth-moving services
Project Estimates and Contracts
All project estimates are valid for 30 days from the date of issuance unless otherwise specified. Estimates are based on the information provided and may be subject to change based on:
- Site conditions discovered during excavation or preparation
- Changes in material costs or availability
- Design modifications or change orders
- Permits, inspections, or regulatory requirements
- Weather delays or unforeseen circumstances
A formal contract must be executed before work begins. All contracts are subject to our standard terms and conditions.
Payment Terms
Payment terms are specified in each project contract. Standard terms include:
- Deposit or mobilization payment required before work begins
- Progress payments based on project milestones
- Final payment due upon substantial completion
- Late payment fees of 1.5% per month on overdue amounts
- Interest on unpaid balances at the legal rate
We reserve the right to stop work and/or file liens for non-payment in accordance with Texas law.
Project Timeline and Scheduling
Project schedules are estimates based on normal working conditions. Delays may occur due to:
- Weather conditions affecting concrete placement
- Permits, inspections, or regulatory delays
- Changes in scope or design
- Material delivery delays
- Force majeure events
We will make reasonable efforts to meet scheduled dates but cannot guarantee completion dates. Liquidated damages for delay are not applicable unless specifically agreed in writing.
Quality Standards and Warranties
All work is performed in accordance with industry standards and applicable building codes. We provide:
- ACI-certified concrete placement and finishing
- Quality control testing as required by specifications
- One-year warranty on workmanship against defects
- Manufacturer warranties on materials (as applicable)
Warranties do not cover damage from abuse, neglect, natural disasters, or normal wear and tear. Concrete is subject to normal cracking and shrinkage.
Permits and Inspections
Client is responsible for obtaining all necessary permits and approvals. We will assist with permit applications when requested. All work is subject to inspection by local authorities having jurisdiction. We are not responsible for delays caused by inspection scheduling or failed inspections due to non-compliance with codes.
Safety and Site Conditions
We maintain OSHA 30-hour certified crews and comply with all safety regulations. Client agrees to:
- Provide safe access to the work site
- Ensure utilities are properly marked and protected
- Remove hazardous materials from the site
- Provide adequate space for equipment and materials
- Comply with all site safety requirements
Liability and Insurance
We maintain general liability insurance and workers' compensation coverage. Our liability is limited to the contract amount unless otherwise specified. We are not liable for:
- Consequential or incidental damages
- Loss of use or business interruption
- Damage to existing structures or utilities
- Acts of God or force majeure events
- Client's negligence or failure to provide accurate information
Change Orders
All changes to the original scope of work must be documented in writing through a change order. Change orders will include pricing adjustments and schedule impacts. Work performed outside the original contract scope without a change order may be billed at time and materials rates.
Termination
Either party may terminate the contract with 7 days written notice. Upon termination:
- Client is responsible for payment for all work performed
- We will be compensated for materials ordered and work in progress
- A reasonable demobilization fee may apply
- Any outstanding amounts become immediately due
Dispute Resolution
Any disputes arising from the contract will be resolved through good faith negotiation. If resolution cannot be reached, disputes will be submitted to binding arbitration in Smith County, Texas, under the rules of the American Arbitration Association. Texas law governs all contracts and disputes.

Governing Law
These terms are governed by the laws of the State of Texas. Any legal action must be brought in Smith County, Texas. Client agrees to jurisdiction and venue in Texas courts.
