By using our Service, requesting quotes, or submitting information through our website, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service or website.

Service Role

Concrete Contractors of Tyler operates a marketing and referral service that introduces consumers to construction providers. We are not a construction contractor and do not perform construction work. We facilitate connections between consumers seeking construction services and qualified providers.

No Guarantees

Project outcomes, availability, timelines, pricing, and provider qualifications are not guaranteed. We make no representations or warranties regarding:

• The quality, timeliness, or outcome of any construction project
• The availability or qualifications of any provider
• The accuracy of project estimates or timelines
• The suitability of any provider for your specific project
• Compliance with local building codes or regulations

You are responsible for verifying provider credentials, licenses, insurance, and references before engaging their services.

Non-Circumvention

You agree to communicate with providers introduced through the Service only through our designated phone numbers and email relays for 24 months after introduction. Bypassing our routing or directly contacting providers to avoid our Service may result in liquidated damages equal to the value of the referral fee we would have received.

This non-circumvention provision applies to all providers introduced through the Service, regardless of whether you ultimately engage their services.

Provider Disclosure

We may disclose the legal name of a selected provider solely for consent and routing purposes. We do not publish provider contact details, including phone numbers, email addresses, or websites. All communications with providers must be routed through our Service during the 24-month non-circumvention period.

Consent and Communication

By submitting information through our Service, you consent to be contacted by the selected provider via call or text using the number you provide. Message and data rates may apply. Consent is not a condition of purchase. You may withdraw consent at any time by contacting us or replying STOP to text messages.

Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Scrape, crawl, or use automated tools to access or collect information from the Service
• Submit false, misleading, or fraudulent information
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to circumvent security measures or access restricted areas of the Service
• Use the Service to transmit spam, chain letters, or unsolicited communications
• Violate the non-circumvention provisions described above

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limits of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us, if any, in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Concrete Contractors of Tyler and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in Smith County, Texas, under the rules of the American Arbitration Association, except that we may seek injunctive relief in any court of competent jurisdiction to enforce the non-circumvention provisions.

Changes to Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
